I was applying the maxim to a very specific situation, that of the Canadian Indians, and the legitimacy of the non-native Canadians' claims to Canadian land ownership, all of which derive ultimately from Crown grants.
I don't know the context of Crocat's remark, but depending on context, I would not necessarily disagree with it. I'll stand behind the remark I made, "Past is Past," within the context I used it in.
