I'm GUESSING that what happened here, is the officer asked him to hand over his rifle, in his investigatory status (for safety reasons, the gentleman was carrying a pseudo assault rifle), but in the gentleman's mind, per what his attorney was saying, he hadn't done anything wrong, so there should have been no need to.  The problem is, the officer can rightly perceive a threat if he sees someone with a weapon, and its reasonable to ask that gentleman to temprorarily hand over his weapon, until the officer can verify the facts and story.

If this gentleman failed to hand over the weapon at that time, the officer can reasonably be concerned.  My GUESS again, is if the gentleman had handed over his rifle initially when asked, he'd have been given it right back after just a few minutes of the officer investigating the man's story.  But because he believed he wasn't doing anything wrong, he was at the same time doing something wrong by not temporarily handing the rifle over, at the officer's request

Yea, right......that's what it has to be     ::)     That's why the original charges were dropped down to a mere misdemeanor, because the fella legally carrying his weapons was "looking for trouble"

You know, it's funny.......folks like Xo, & BsB, constantly tripping over themselves in trying to imply that simply owning a gun, especially if its a pseudo "assault weapon", makes one a "gun nut", whatever that's supposed to mean.  And don't even think about legally carrying one, egads, that puts you on the fringe of insanity, just looking for trouble, ready to gun down anyone and everyone that dares to look at you cross-eyed

So, where's all these stories of CCW holders gunning people down?  We had 1, Zimmerman, and even that has been lost in the cloud of facts, as apparently Martin was the one on top of Zimmerman, beating him to a pulp before Zimmerman shot him.  So, there's ONE.  Yet you listen to the rhetoric of Xo, and you'd think we'd have one a day, when you consider the thousands of CCW holders, across the country, that are supposedly gun nuts, just looking for trouble

I'm supposedly the epitomy of a crazed right wing wacko.  I've had a CCW for close to 2 decades now, in the state as left wing as they can come.  Never once having to pull it, only once having to consider pulling it, but thankfully didn't have to.  No one's saying "I need a CCW", merely that I have the legal right, should I follow all the legal loopholes, to have one.  It's gotta drive folks like Xo & Bsb crazy to know that sirs is the walking contradiction of what a crazed RW gun nut is supposed to be

Once I was stopped and asked to get out of my truck.

When I was standing the officer deftly picked my knife from my pocket and tossed it into the window of my truck.

He said he did it for the safety of us both.

I think he must have practiced that maneuver a lot to have done it so fast and well.

I did not complain and soon my history was displayed on his dash, no warrants , he bid me good day and get that taillight fixed.

So the incident was over.

Frankly I think his thinking is weak on the subject, having another wepon where he would not have seen it would have been pretty easy if I were of a mind to fight.
Having a wepon he could see did not really increase the threat, if anything he took a risk he did not need to.

But I am generally co-operative in such situations and hopefull that the odds are in my favor to be dealing with reasonable policemen, so there was little trouble and no lasting effect.

Even though I don't think he did right , I do think he was not malicious , I accepted his action on the idea that it was done in good faith even if mistaken.

I don't think that guy with the rifle acted wisely, the best time to complain is later, with your lawyer by your side.

Supposed he walked passed by a house on a stand your ground state. That rifle might pose a Problem since a home owner is not going to ask if he's legally allowed to carry. But thats not a viabe scenerio since he on a wilderness trip and it's super stupid for him to carry that in a residential area. Legal or not. On second thought thats likely what happened since how the hell is a officer be in that area unless somebody called

From every report I've seen, it was indeed a hike in a very rural area, so highly unlikely he walked in front of anyone's home.  And police officers can respond pretty much anywhere, though generally it's the Sheriff's service that responds to calls outside city limits.  Point being, if he's legally able to carry, it shouldn't matter what anyone else thinks.  I have no problem if the police were called by someone, perhaps another hiker, who saw a man with a rifle.  I have no problem with the officer asking the former soldier to hand over his rifle, in the course of his investigation, for safety purposes.  Perhaps had he done so, if indeed he didn't initially until back-up arrived while the officer had him a gunpoint, the gentleman would have finished his hike, long ago, with all his legal weapons on his person

To reference the hypothetical, if a person simply walks by a home, with a rifle on his shoulder, I don't see the homeowner getting away with shooting him.  Forensics would be able to tell that he was never advancing or pointing the rifle at the home.  He'd be found on the sidewalk, rifle still slung over his shoulder, and no gun powder residue.  I concur though, it's be extremely unwise to walk down a residential neighborhood with a rifle in tow.
