Kagan & Obamination Care
« on: December 05, 2011, 05:42:53 PM »
With the Supreme Court set to rule on the measure, before the 2012 elections, does anyone seriously believe that she didn't explicitly help craft the legal defense, and thus is still capable of making an impartial decision about its constitutionality??

Does the Supreme court require the respect of the public?

Congress seems to be getting along well enough without it.

Nor is there any criteria or requisate that a sitting Supreme Court Justice have to recuse themself.  The issue is should they in a particular instance where impartiality is highly unlikely due to a preexisting situation where they had sided with 1 side.  IIRC messers Scalia & Thomas had frequently been called to recuse themselves for conflicts far more ambiguous.  Thomas in fact has been requested to recuse himself from the Obamination case, for a supposed conflict his wife has.  "Ethically challenged" former representative Anthony Weiner claimed a need to "maintain the integrity of this court.”

So, where are the same requests for Kagan's concern for court integrity??
