What are your thoughts on the Lanya tangent, is she and the author of the article on the right track on this? Or is she trying to make applesause from oranges?

Will lawyers use some of the language when their clients face perjury and obstruction of justice charges and sentencing?

I'd think so. Isn't that what good defense attorneys do? Look at all the possibilities and legal avenues to try and defend their clients, including getting them to serve the least possible amount of time in prison?

Now, whether a judge will accept such arguments is another issue. I don't think I'd blame an attorney for trying, would you?

From what I can gather, these are attorneys (and a former Federal judge) making these statements. I respect the intelligence of a number of people on this forum, we have a great diversity of experience and knowledge here and that is one reason we have some really good debate. Yet, I'll be the first to say that I'm no attorney and this isn't my field of expertise by any means.

It interests me to hear the legal arguments of why this would disgust prosecutors and the legal arguments of those who disagree.

As I said, apparently Lanya is advocating crossing out sections of the Constitution she doesn't like.  Makes sense since she also supports crossing out portions of the 1st amendment as well, with her unFariness Doctrine support     >:(

Of course, you'll show me what parts of the Constitution I'm advocating the x-ing out of, as it relates to American citizens, won't you?  I thank you in advance

BINGO, especially as it relates to a foreign enemy who has pledged to kill not just American citizens but anyone not Muslim, and not willing to be subjugated by it, and in no way abides by any set of rules or the Geneva Convention.  And last time I checked, the Constitution was specific to American citizens.  Last time I checked the Constitution had no jurisdiction to any other country or province outside of America & Americans.  Is this incorrect?

Thank you.  I assume then you have no examples to provide me, as I was able to provide regarding Lanya.  So much for the pot/kettle reference

As I understand it (and I believe I've posted it), when you commute someone's sentence, they must have at least started serving it.   So that's one thing that's up in the air here.  He hasn't served any time. 

Time spent while being booked is considered to be part of time served. Maybe it was only a day, but Libby was booked, and therefore he spent time in jail.
