Well ...

I don't like Grafitti most of the time, but this is really nice , I would vote to make a exception for art of this quality.

  What is the hurry?
They should wait for someone to sue, or even just object.

There is no reason to spend a dime on this very popular art that no one has raised objection to as yet.

Then let whoever wants to sue bear the bad.

Quote
In North County, the street-smartest artist is Bryan Snyder, the Carlsbad muralist who famously transformed the Cardiff Kook statue on Vincent Van Gogh’s birthday.

Though a few art locals suspect Snyder may be the perpetrator of the beautiful crime, he says he’s “not taking credit.” Neither is he straight-out denying a role, saying he prefers to preserve the Surfing Madonna’s “mystery” (as well as take out of play, one can imagine, financial and/or criminal liability).

Whoever the artist is, Snyder posted a relevant “rubric,” a checklist that concludes — no surprise — that the Surfing Madonna deserves to be elevated from illegal street art to public art, a not unprecedented transaction called “accessioning” in the art world.

I am thinking that no mosaic can be called "graffitti".

Most graffitti here in Miami consists of illegible, purposefully ugly scrawls, made by dolts marking territory like tomcats spraying on trees and fence. In Spain and France, I saw a lot of that as well, but along the train tracks, there were some amusing cartoons that were clever and rather artistic. We have had only a little of this in Miami.

I agree that this is not graffitti, and it would be best just to legalize it, as they did with the Watts Towers and Carhenge.

I question the premise that the Virgin of Guadalupe is a surfing type, but the mosaic unifies a Mexican icon with a surfing icon and should get an A for artistic.
