According to Reid & Biden, there is no such immediate mandate requirement.  And Scalia wouldn't have ruled in any way, since this isn't a function of the judiciary.  Its the function of the legislative branch

And you have absolutely no leg to stand on, in trying to proclaim what the Founders meant, with your ridiculous notions like the 2nd amendment was placed there to hunt down slaves     ::)

It is the job of the Senate to follow the Constitution. It is clarely their duty to give the nominee a hearing.  Scalia would have to have ruled that way, it was clearly what the Founders meant.

The founders definitely wanted the citizens to have strong influence on the political process.

When the people are alarmed at unified party actions , they vote in divided government.

Putting the brakes on the Obama program is a lot more popular with the public than letting the Democrats enact the full platform.

For two years President Obama had the Democratic Senate to help him, I think his choices during that time were such that divided government looked good to most people.

People do not vote for a divided government. They vote for Democrats or Republicans.

  In every election different sets of people stay home.

  After a hero fizzles his fans grow apathetic .
  This describes a different set every time.

   When a president has a co-operative congress he gets his program rolling , which is often enough to frighten many out of their apathy.

Each American decides how to vote and whether to vote. I do not recall any campaign in which any candidate has declared, "a vote for me is a vote for divided government that will not function."

Candidates don't run on any such platform, but I've heard and come across countless people who votes with the goal of stopping the other party,  that they believed was out of control
