Cheney to be defense witness in CIA case

WASHINGTON - Vice President Dick Cheney will be called as a defense witness in the CIA leak case, an attorney for Cheney's former chief of staff told a federal judge Tuesday.

"We're calling the vice president," attorney Ted Wells said in court. Wells represents defendant I. Lewis "Scooter" Libby, who is charged with perjury and obstruction.

Early last week, Special Prosecutor Patrick Fitzgerald said he did not expect the White House to resist if Cheney or other administration officials are called to testify in Libby's trial, expected to begin in January.

Libby is accused of lying to investigators about what he told reporters regarding former CIA operative Valerie Plame. Plame's identity was leaked to reporters around the time that her husband, former ambassador Joseph Wilson, publicly criticized the Bush administration's prewar intelligence on Iraq.

Sitting presidents, including Clinton and Ford, have testified in criminal cases, but presidential historians and separation-of-powers experts said they knew of no vice president who has done so. The first President Bush was subpoenaed to testify in the Iran-Contra trial of Oliver North. At the time, Bush was Reagan's vice president, but Bush was president by the time a judge ruled he did not need to testify.

In addition to Cheney, other government officials and journalists are expected to be key witnesses in the trial, which is scheduled to start next month.

Former New York Times reporter Judith Miller and NBC News Washington bureau chief Tim Russert are expected to be prosecution witnesses. Libby's lawyers said in court papers that several reporters will testify on Libby's behalf.

Two unidentified reporters may resist testifying, Libby's attorneys said, but they expect to resolve that issue before trial.

Libby also has sought a subpoena for the tape of Washington Post reporter Bob Woodward's interview with former Deputy Secretary of State Richard Armitage. Armitage has admitted he discussed Plame's job with Woodward in 2003 but said it was a passing, inadvertent comment.

If admitted into evidence, the tape could be played at trial. The tape has been turned over to prosecutors, and Libby's attorneys said they expect no objection to their subpoena.

Cheney, who would be the trial's most anticipated witness, has said he may be called to testify. If so, prosecutors could ask how the White House responded to Wilson's criticisms. Cheney was upset by Wilson's comments, Fitzgerald has said, and told Libby that Plame worked for the CIA.

That conversation is a key to Fitzgerald's perjury case. Libby testified that he learned about Plame's job from a reporter.

Cheney could also help prosecutors undermine Libby's defense that he was so preoccupied with national security matters, he forgot details about the less-important Plame issue. Prosecutors argue that Plame was a key concern of the vice president, and thus would have been important to Libby.

Cheney and Libby got to know each other when Cheney was defense secretary under the first President Bush. Libby has been extremely loyal to Cheney and, in return, had the vice president's unwavering trust.

By 2000, Libby was working as a top adviser to Cheney in the presidential campaign and then followed him to the White House. In the White House, he was known as "Cheney's Cheney" for being as trusted a problem solver for the vice president as Cheney was for Bush.

Even after Libby's indictment, Cheney called him "one of the finest men I've ever known."

CHENEY TO TESTIFY IN NON-LEAK CASE

The defense in the Valerie Plame case says they intend to call Dick Cheney to the stand, making him the first sitting vice president to testify in a criminal case.

Why is there even a trial being held in this case? What laws have been broken ? And why is taxpayer money being spent on this mess?

The media calls this the "CIA leak case," but that is not accurate. The reason is because nothing was ever leaked. No one has been charged with leaking anything. And why? Because there was nothing to leak! Valerie Plame's identity was not a secret and she wasn't a covert agent. The whole thing is an imagined Watergate-style fantasy by the mainstream media.

What the trial really is about is just as flimsy. It's actually the perjury/obstruction of justice trial of Scooter Libby. Tens of millions of taxpayer dollars are going to be spent prosecuting a man who will in all likelihood, wind up being acquitted. Either that or President Bush will pardon him on his way out of office in 2009 and the whole thing will have been a giant waste of time.

But not if you ask the media...to them, this is the trial of the century. Yawn.

And yes, Bush will probably pardon whoever in his administration is found guilty of whatever. But then in this case, there's the civil trial later. For which there is no pardon. THAT is what I am looking way forward to.
  And so I do very much hope CHeney remains in excellent health for many years to come.

Even though President Clinton is certainly guilty of Purjury , all the eagerness to procicute him seems to be gone.

Libby is guilty of being a Republican .

My dad worked for a Republican governor.   I went to Nixon and Goldwater rallies as a kid, I cheered when we won, cried when the Democrats won.

Then I grew up and my eyes were opened.

Sorry Lanya, but you are jumping up and down in happyness at the prospect of a prosicution , and you have no idea what he guy did wrong except that he is a Republican.

If that is eyes open ....well ..I am not impressed with it.

I really get the impression that you think that joining the Republican party is proscicutable and that your eyes are shut to all argument other then the ones you have already been conditioned to.

You recall that Valerie Wilson was a CIA employee?  Working under non-official cover on weapons of mass destruction? You recall that outing her ruined her network, possibly cost lives and she can't work there anymore? 

And you don't think I want the son of a bitch who did that on trial?  Yes I do very much.  I'm looking forward to it.  Democratic, Republican, Libertarian, I don't care.

It is still absolutely ridiculous how they made up crap to save Cheney's worthless hide. They got that old fatbastard Armitage to say that he mentioned Plame's being a CIA agent, and somehow he wasn't indictable for reasons no one has explained. Novak was the one who mentioned it first in public, but somehow he's totally innocent.

This was obviously a nasty, vindictive payback for Wilson telling the truth and trying to prevent the worst blunder these doofuses have ever made.

Plane, try to think for just a minute.

Your country is at war.  You've been attacked by terrorists.  And then a former ambassador writes an op/ed titled "What I didnt' find in Africa" (or Niger or wherever) and then, hey, someone burns a CIA agent who is senior, and who is involved with WMD.

Now are you going to be a little bit mad at the person who burned an agent of his own country, or at me, for having the audacity to be very much on the lookout for the bastard's trial?   Excuse me, who is being partisan here?  ME?
