That is not even close to assault. The "student" refused to identify himself. Why?

There in no law requiring anyone to converse with anyone recording them on the street. No one was even mildly injured.

That is not even close to assault.

"Assault" is the threat of physical contact. "I'm gonna shove you out of my way" is assault.

"Battery" is the actual use of physical contact, like landing a blow.

Therefore, a charge of "assault and battery" is the threat of physical force, followed up by actual use of physical force. You can be charged for each, or both simultaneously.

There was no assault, there was no battery. There were no cuts, no bruises no pain, no suffering.

The "student" does not have a right to stick a camera in anyone's face and ask questions. He should have identified himself. The Congressman has no obligation to talk to this punk or to allow himself to be photographed. The same applies to those who are NOT congressmen.

This will have no consequences whatever. The public will see it for what it is.

Slapping the phone out of his hand and holding on to him when he requested that he be let go are both examples of battery.

The "student" refused to identify himself. Why? There in no law requiring anyone to converse
with anyone recording them on the street.

There is no law requiring reporters, film crews, citizens asking questions on a public
street to identify themselves.

The out of control Dem Congressman has no right to grab/touch/or slap equipment out
of a law-abiding citizen's hand on a publuc street.

If this had been a Republican Congressman, coverage would be running wall-to-wall
on CNN/CBS/ABC/NBC/MSNBC.

This Congressman will be apologizing soon or he will be gone.

Not to get too stereotypical, but the congresscritter's initial reaction reminded me of many of my agitated dementia patients......the eyes, the mode of grabbing, the stare of agitation, the repetition of questioning the same "who are you?"

Not saying or even inferring anything.  Just an observation

Any NORMAL Congressman would not be so hostile and take it in stride. This guy should be used to this sort of thing. Clearly this Democrat has an anger problem.

When someone stands in front of you, you have 2 choices, if you wish to continue to walk.  Walk around or walk thru.  1 avoids confrontation, 1 ensures confrontation.  Not to say the person standing in front of you is not at fault, but the person walking, will likely dictate the direction the rest of the events will unfold, based on the 2 above options

You are thinking too hard. The CMan is a public official, he was elected to use good judgment. Good judgment is to remain cool, calm, collected and handle the situation like a relational adult. Do you get my point? This man is being judged for being an asshole and treating a young college kid badly. It really matters not whether this was an assault, what matters is this guy comes off like a jerk. Anyone thinking this behavior will attract voters is just wrong. Plus the CMan looks like a dork that needs to lose his job.
